General Provisions

These Terms govern the use of the online store operated by Acephala Monika Kędziora, based in Warsaw at al. 3 Maja 14, available at acephalafashion.com.

In these Terms, "we", "us" and "our" refer to Acephala. By using the website or placing an order, you accept these Terms.

These Terms apply to all users of the website, including browsers, customers and other users making use of services provided electronically through the store.

Use of the Store

You agree to use the online store in compliance with applicable law, good practice and these Terms.

You may not use the store or its content for any unlawful purpose, to infringe the rights of third parties, including copyright or other intellectual property rights, or to interfere with the operation or security of the website.

Product Information

Information about products, descriptions, prices and availability presented on the website constitutes an invitation to enter into a contract unless expressly stated otherwise.

We make every effort to display product descriptions, images and colours as accurately as possible. However, due to individual device and screen settings, the actual appearance of a product may differ slightly from its presentation on the website.

Certain products may be available exclusively online and in limited quantities.

Prices and Payments

All prices displayed in the store are shown in the currency indicated on the product page and, unless stated otherwise, include applicable taxes.

The total price of the order, including delivery costs and any other charges, is presented to the customer before the order is placed.

Available payment methods are indicated in the online store during checkout.

We reserve the right to change product prices, but any such change will not affect orders placed before the change takes effect.

Placing and Processing Orders

Orders may be placed through the online store 24 hours a day, subject to technical interruptions.

To place an order, the customer provides the information necessary to process the order and selects the product, delivery method and payment method.

After the order is placed, the customer receives confirmation at the email address provided. The sales contract is concluded in accordance with applicable law and the rules presented during the checkout process.

We reserve the right to refuse or cancel an order in justified cases, in particular where the information provided is incorrect, payment has not been authorised, or the order violates applicable law.

Delivery

Delivery is made to the address provided by the customer when placing the order.

Information about available delivery methods, estimated delivery times and delivery costs is presented in the store before the order is placed.

The risk of accidental loss of or damage to the goods passes to the consumer upon receipt of the goods.

Right of Withdrawal

As a rule, a consumer who concludes a distance contract has the right to withdraw from the contract without giving any reason within 14 days from the day on which the goods are received, subject to exceptions provided by applicable law.

To exercise the right of withdrawal, the customer should submit an unequivocal statement of withdrawal.

If the withdrawal is effective, we will reimburse payments received from the customer in accordance with applicable law, subject to cases in which the law allows us to withhold reimbursement until the goods are received back or proof of return is provided.

The customer bears the direct cost of returning the goods unless stated otherwise before the contract is concluded or unless the customer was not properly informed of those costs.

Complaints and Conformity of Goods

If the purchased goods are not in conformity with the contract, the consumer has the right to submit a complaint in accordance with applicable law.

Customer Account

Creating a customer account may require the provision of certain information, in particular first name, last name and email address.

The customer is obliged to provide true, current and complete information.

The customer is responsible for maintaining the confidentiality of access credentials to their account.

External Links and Tools

The store may provide links to third-party websites or tools. Their use may be subject to separate terms of those third parties.

We are not responsible for the content, policies or practices of third-party websites or services linked from the store, unless such liability arises under mandatory law.

Errors and Inaccuracies

Despite due care, the website may exceptionally contain typographical errors, inaccuracies or omissions relating in particular to product descriptions, prices, promotions, delivery costs, delivery times or product availability.

We reserve the right to correct such errors and update information, subject to the consumer's rights under applicable law.

Liability

We do not exclude or limit liability towards consumers to the extent that such exclusion or limitation would be unlawful under applicable law.

In all other respects, our liability is limited to the extent permitted by applicable law.

Restriction of Access

We may temporarily restrict access to the store or refuse to provide services in the event of a breach of these Terms, applicable law, store security, or the rights of third parties.

This provision does not affect consumer rights arising from mandatory law.

Changes to the Terms

We may amend these Terms for important reasons, including changes in law, technical or organisational changes, or changes in the scope of services provided.

The current version of the Terms is published on the store website.

Any changes do not affect rights acquired by customers before the changes enter into force.

Governing Law

Contracts concluded through the store are governed by Polish law, provided that the choice of Polish law does not deprive a consumer of the protection granted by mandatory provisions of the law of the country of their habitual residence.
